Drug law is an expansive area of the criminal law, ranging from simple possession of cannabis to importation of commercial quantities of dangerous narcotics such as cocaine and heroin. In addition to substantial jail sentences for many of these offences, offenders can face firearm prohibitions and severe difficulty engaging in future international travel, often permanently. As well, authorities have significant power to seize the substantial assets of those convicted, or even suspected, of drug offences.
Most drug related crimes are outlined in the Controlled Drugs & Substances Act, including possession, trafficking, distribution, importation and cultivation. However, several related crimes such as money laundering are contained in the Criminal Code of Canada.
Drug prosecutions can involve lengthy and complex trials dealing with expert evidence, Charter of Right violations and wiretap challenges. Several of the criminal lawyers at DDSG have developed extensive experience in the defence of drug crimes.
