Client acquitted of sexual assault by jury where he testified to no sexual intercourse ever taking place, never mind non-consensual. Also acquitted of failure to appear for first jury trial where he received call from female purporting to be from his lawyer’s office and advising charges dropped. Evidence established no such call from lawyer’s office occurred, but client testified as to his sincere belief in the call being genuine. Client returned to his home province for several years traveling freely to places such as the United States prior to being arrested for failing to appear.
