Client pled guilty to counseling murder and uttering death threats. The client was involved in a dispute over the ownership of two properties. The client then attempted to hire a hit man to kill 8 family members of the person with whom she was engaged in the property dispute. The client had spent 7 months in pre-trial custody.
Held: 1 year Conditional Sentence (House Arrest), and probation.
Although counseling murder typically results in lengthy jail sentences, no jail was required in the present case given that the client had plead guilty, suffered from anxiety and depression, and did not constitute a risk to safety of the community.
