Accused pleaded guilty to various offences including possession of a sawed off shot gun. Police received reports around 6:30 pm of an individual at a Calgary LRT station who had a gun concealed under his clothing. Upon arrest a sawed off 20 gauge shot gun was found under the accused’s jacket. Lengthy criminal record. Crown sought 4 years jail.

Held: 4 years jail.

Very serious offence. “Gun related crime poses grave danger to Canadians”: Nur, 2015 SCC 15. Although various Gladue factors were present, on the basis of the accused’s record alone he was not a candidate for a community based sentence, although the factors did somewhat reduce moral culpability. The accused was subject to 6 separate firearm prohibition orders at the time of the offence.
