Accused charged with several offences arising from an incident in which he shot at police. NCR application. Crown argument that intoxication triggered any form of mental disorder at the time of the incident.
Accused was suffering from auditory hallucinations at the time of the shooting, and the opinion of one treating psychiatrist was that the accused’s bipolar and schizoaffective disorder led to the accused being NCR. Based upon competing opinion evidence, Court was unable to find that the accused was in a self-induced state of mental disorder. “Bouchard-Lebrun 2011 SCC 58 is distinguishable on its facts. Mr. Morrill did not have a drug/alcohol induced psychosis.”
