Charges for possession of a loaded prohibited firearm, possession within a motor vehicle, and possession in contravention of a weapons prohibition. Charges dismissed by the Court

Facing a lengthy penitentiary term if convicted this Accused proceeded to trial before Justice Jerke of the Court of King’s Bench. The Crown alleged that the Accused was the driver of a car pulled over by police in the early morning hours. Found in the backseat of the vehicle was a handbag containing a loaded handgun. When police experts examined the gun they located a fingerprint on the magazine which they identified as belonging to the Accused. Cross examination of Crown expert witness revealed the weaknesses in this conclusion and ultimately defence evidence raised a reasonable doubt in the Court’s mind resulting in acquittal on all weapons charges
