Client charged with sexual assault. Complainant had received a text message in the early morning hours asking him to come alone to a particular room in a work camp. Complainant testified he responded to the text message thinking there was some sort of emergency, and upon arriving at the room was touched in a sexual manner by the client. The client testified he thought the complainant was making advances towards him earlier in the evening, and invited the complainant to his room for a consensual encounter. Client acquitted when trial judge accepted his evidence, and took note of the complainant’s defensiveness under cross-examination.
