Client charged with driving while impaired by a drug. Police conducted a drug recognition evaluation on client and testified that he appeared extremely intoxicated. Aurinalysis revealed various drugs in his system. Client testified that he had consumed cocaine three days prior but was not impaired on the offence date and was merely tired after driving for 18 hours.
Held: Not guilty. The trial judge accepted the client’s evidence.
