Client acquitted of charges alleging possession/use of a firearm, to wit: a handgun. Witnesses had testified that client had shot a “gun” out of a moving van. No weapon, bullets, or shells were recovered. Trial judge found that crown failed to prove that the object in question was a firearm as defined by the provisions of the Criminal Code.
