Client pleading guilty to weapons’ offences relating to using an unlicensed loaded handgun in an attempt to gain entry to a nightclub after being involved in an earlier altercation inside of same. Persuaded to leave but not before shooting several shots into the air as he left in a vehicle. As subsequent search of his residence revealed other weapons, some stored improperly. Crown dropping original charges involving 3 and 4 year minimum jail sentences in return for guilty plea.

Held: Court accepted joint submission for a 12 month sentence and 3 years probation.

Client had been under restrictive house arrest without serious infractions while out on bail and had returned to a life of sobriety and positive relationships. Court satisfied of remorse and rehabilitation.
